Acceptable Use Policy

What you can — and can't — do on our servers.

1. Purpose

This Acceptable Use Policy ("AUP") describes content and activities that are not permitted on Ameritechwebs Hosting services. It is incorporated into our Terms of Service by reference.

Our goal is to keep our network safe, secure, and reliable for all customers. Violations of this AUP may result in suspension or termination of your account without refund.

2. Prohibited Content

You may not use our Services to host, distribute, or link to:

  • Content that violates any applicable law or regulation
  • Child sexual abuse material (CSAM) — reported immediately to NCMEC and law enforcement
  • Content that infringes copyright, trademark, patent, or other intellectual property rights
  • Content that promotes terrorism, mass violence, or hate speech against protected groups
  • Defamatory, libelous, or fraudulent content
  • Content depicting non-consensual acts
  • Phishing pages, scam pages, or fake login forms
  • Malware, viruses, trojans, or any malicious code
  • Counterfeit or pirated software, media, or goods
  • Illegal pharmaceuticals or controlled substances

3. Prohibited Activities

You may not use our Services to:

  • Send spam — bulk unsolicited email, including marketing without opt-in consent
  • Engage in phishing — collect login credentials or financial info via deception
  • Mine cryptocurrency — without prior written permission (shared hosting only)
  • Run public proxies, VPN exit nodes, or Tor exit nodes
  • Conduct attacks — DDoS, brute force, port scanning, or other network abuse
  • Distribute malware or viruses — regardless of intent
  • Bypass our security or rate limits
  • Access other customers' data — even accidentally; report it immediately
  • Run high-frequency torrent or file-sharing servers
  • Operate gambling sites in jurisdictions where they are illegal

4. Resource Usage

Shared hosting accounts share server resources. Excessive resource usage that degrades performance for other customers may result in account suspension or required upgrade to a larger plan.

4.1 Reasonable Use Limits

For shared plans (Starter, Business, Pro):

  • CPU: No single process should exceed 25% CPU for more than 60 seconds
  • Memory: Limited to plan allocation (1 GB Starter, 2 GB Business, 4 GB Pro)
  • Inodes: 250,000 (Starter), 500,000 (Business), unlimited (Pro)
  • Concurrent connections: 25 (Starter), 50 (Business), 100 (Pro)
  • MySQL queries: Reasonable use; query optimization may be required for high-traffic sites

4.2 If You Exceed Limits

We will:

  1. Notify you via email within 24 hours of detection
  2. Work with you to optimize your application
  3. Recommend an upgrade if optimization isn't sufficient
  4. Suspend only if usage continues to harm other customers

5. Email Sending

To protect our IP reputation and prevent spam:

  • Maximum 500 emails per hour per cPanel account
  • Maximum 2,000 emails per day per cPanel account
  • Recipients must have opted in to receive emails from you
  • SPF, DKIM, and DMARC records are required for bulk sending
  • Bounce rate must remain below 5%

For high-volume legitimate email sending, we recommend a dedicated email service like SendGrid, Mailgun, or Postmark.

6. Backups

While we perform automated backups, customers are responsible for their own off-site backups. We are not liable for data loss due to:

  • Customer error (accidental deletion, hacked passwords)
  • Account suspension or termination for AUP violations
  • Catastrophic failures (natural disasters, etc.)

7. Security

You agree to:

  • Keep your software, themes, and plugins up to date
  • Use strong, unique passwords (we recommend 2FA)
  • Report any suspected compromise to security@ameritechwebs.com immediately
  • Allow us to scan your account for malware
  • Cooperate with our investigation if abuse is reported about your account

8. Reporting Abuse

If you believe a site hosted on our servers is violating this AUP, please report it:

  • Email: abuse@ameritechwebs.com
  • Include the URL, evidence (screenshots, logs), and a description of the violation
  • We investigate all reports within 24 hours and take action within 72 hours

9. Enforcement

If we identify a violation, we will:

  1. For minor violations: Send a notice with 24-72 hours to remedy
  2. For serious violations: Suspend the account immediately and notify the owner
  3. For severe violations (CSAM, terrorism, active attacks): Terminate immediately and report to authorities

Account terminations under this AUP are not eligible for refunds.

10. Appeals

If your account is suspended and you believe it was in error, contact appeals@ameritechwebs.com with your case. We review all appeals within 48 hours.

11. Changes to This Policy

We may update this AUP from time to time. Material changes will be communicated via email at least 14 days before they take effect.
